Terms and conditions

These terms apply to every quote and assignment of Mohamed El Marnissi (Elmarmo), Oude Molenstraat 120/9, 9100 Sint-Niklaas, company number BE 0641.628.967. I work for businesses only, not for consumers. The Dutch version is the binding one.

1. Quote and assignment

An assignment starts after written agreement (email counts) to a quote. The quote describes the work, the price or day rate and the timeline. Extra work is agreed in advance.

2. Prices and invoicing

Prices are in euro and exclude VAT. Invoices are sent by email: fixed-price work as stated in the quote, day-rate work and maintenance monthly.

3. Payment

Invoices are due within 14 days of the invoice date, by bank transfer or online through the payment link in the invoice. Online payments are processed by Mollie B.V. Late payment falls under the Belgian law of 2 August 2002 on late payment in commercial transactions.

4. Delivery and ownership

After full payment the client receives the right to use the delivered code for its own business, unless the quote says otherwise. Existing libraries and my own tooling stay with their owners.

5. Liability

I carry out assignments with due care (obligation of means). My liability is limited to the invoiced amount of the assignment concerned. I am not liable for indirect damage such as lost profit or data loss.

6. Cancellation

An assignment can be stopped in writing. Work delivered until then is invoiced. Amounts already paid for work not delivered are refunded.

7. Privacy

I use client data (name, company, contact and billing details) only to make quotes, carry out assignments and invoice. I do not sell or share it, except with the parties needed for payment (Mollie) and accounting. Invoices are kept as long as accounting law requires. Ask for access or deletion at hello@elmarmo.be. This site uses no cookies and no tracking.

8. Law and disputes

Belgian law applies. Disputes go to the enterprise court of the district where I am established.
